March and April has seen several regulatory updates from 8 countries relating to controlled drugs and drug precursors, including new generic statements controlling areas of chemical space.

 

Below is a brief summary and highlights of some of the countries we monitor and encode in Controlled Substances Squared. The solution that allows you to easily and automatically check if your chemicals are regulated or controlled - even novel and propriatory chemicals

 

 

 

Due to the number and complexity of updates we can't include them all here, just a few of the highlights. 

 

USA
The Drug Enforcement Administration (DEA) is proposing to control 6 new substances under CSA as  Schedule I.

Separately, it is also establishing a specific listing and DEA Controlled Substances Code Number for eutylone (bk-EBDB) in schedule I of the Controlled Substances Act (CSA). 
Although eutylone is not specifically listed in schedule I of the CSA with its own unique drug code, it has been controlled in the United States since March 7, 2014, as a positional isomer of pentylone, a schedule I hallucinogen. Therefore, DEA is simply amending the schedule I hallucinogenic substances list in its regulations to separately include eutylone. Note:

Eutylone was already controlled in Controlled Substances Squared as a schedule I substance

Finally the DEA is also permanently placing 1-(1-(1-(4-bromophenyl)ethyl)piperidin-4-yl)-1,3-dihydro-2H-benzo[d]imidazol-2-one (commonly known as brorphine), in schedule 1, including its isomers, esters, ethers, salts, and salts of isomers, esters, and ethers whenever the existence of such isomers, esters, ethers, and salts is possible within the specific chemical designation.

 

Switzerland
4-HO-DPT, ortho-Desmethyltramadol, BZO-4en-POXYZIDE, MDMB-5Br-INACA, ADB-HEXINACA, Flubrotizolam, ADMB-B-5Br-INACA, Etonitazepipne, Hexahydrocannabinol, Hydroxetamin, Cumyl-CBMegaclone have all been added as a directory E substances.

UK
Recently that UK Advisory Council on the Misuse of Drugs (ACMD) recommended that nitrous oxide is not scheduled. However, in its response to the ACMD, the UK government (Government response: ACMD nitrous oxide review) states that it is the intention of the government to ignore this scientific advice and control Nitrous oxide as a Class C substance. 
However the UK government have agreed with the advice of the Advisory Council on the Misuse of Drugs (ACMD) in regards to scheduling Remimazolam. Remimazolam will be scheduled as a Class C / Schedule 4 (Part 1)

For sometime Scitegrity have been wondering how and when the UK government would legislate to control new emerging drug precursors. In theory, the UK was supposed to be mirroring EU action in this area, but that has not been happening, leading to confusion on whether and when these substances would be controlled.

This document issued by the UK government explains its current position on the control of new drug precursors following the UK’s exit from the European Union. Since the UK stopped mirroring updates to those EU regulations that had passed into UK law, the EU has controlled a further seven drug precursors. Currently these precursors are not controlled in UK law, which means they are not controlled in England, Scotland or Wales, but are controlled in Northern Ireland as Northern Ireland is still subject to compliance with EU regulations because of the Northern Ireland Protocol. The drugs precursors concerned are; EAPA MAMDPA 4-AP 1-boc-4-AP norfentanyl DEPAPD PMK ethyl glycidate. 
The UK government will now consider if, when and how they will legislate to control these in the rest of the UK in future.

Belgium
The following controlled substances were added to Annex IA -  Brorphine Metonitazene, Annex IB -Eutylone, Annex IIC - 3-MMC 3-CMC, Annex IVB BZO-CHMOXIZID, BZO-HEXOXIZID, BZO-POXIZID, 5F-BZO-POXIZID, BZO-4EN-POXIZID, 2C-B-FLY, 5F-Cumyl-Pegaclone, Deschloroetizolam, 3-Desoxy-MDPV Deoxymethoxetamine, 5-EAPB ETH-LAD, Etonitazepipne, Etodesnitazene, Flubrotizolam, Fluetizolam Flunitrazolam, Fluoroethylphenidate, Hexahydrocannabinol, Hydroxetamine, Gidazepam, 1B-LSD, 1V-LSD, LSZ, 5-MeO-AI, Me-PCP, Me-PCPy, NM-2AI, Protonitazene, Thiothinone, TH-PVP

Also in an amendment to the Belgian legislation two new generic statements were enacted to place under control 2C-X derivatives and NBOMe derivative, an example of these are shown below

Ten substances have been added to the Brazilian controlled substance lists, including List B1; Eszopiclone GBL List C1; Mavacamten List D1; 1-boc-4-AP 4-AP Norfentanyl List F1; Brorphine Metonitazene List F2; 1cP-LSD Eutylone


UN
VIENNA, Austria – March 2023: At its 66th regular session from 13 to 17 March 2023, the Commission on Narcotic Drugs decided to place seven new psychoactive substances under international control. Following recommendations by the WHO, four substances were added to the relevant schedules of the Single Convention on Narcotic Drugs of 1961 as amended by the 1972 Protocol and three substances were added to the Convention on Psychotropic Substances of 1971.

Added to the Single Convention on Narcotic Drugs of 1961, as amended by the 1972 Protocol - (Schedule I): 2-Methyl-AP-237 Etazene Etonitazepyne Protonitazene 
Added to the Convention on Psychotropic Substances of 1971 – (Schedule II): ADB-BUTINACA alpha-PiHP 3-Methylmethcathinone
The only addition to the Green list is Eutylone, which was added to Schedule II. Eutylone has been controlled in CS2 since the announcement by the Commission on Narcotic Drugs.

Japan
In this announcement seven substances have been made Designated Drugs under the Pharmaceutical and Medical Devices Act; MET 1V-LSD Δ9-THC-O Δ8-THC-O 4F-Furanylfentanyl HHC-O-acetate 3-Me-PCPy

Italy
This amendment adds 12 substances as controlled substances to Table 1: o 3,4-Pr-PipVP o 4-HO-McPT o 5-HO-DMT o 5-MeO-DiPT o ADB-4en-P-5Br-INACA o ADB-B-5Br-INACA o ADB-D-5Br-INACA o ADB-P-5Br-INACA o MDMB-INACA o MDPBP o N-Butilbutilone o N-Cicloesil metilone
